Employee's State Insurance (ESI) Registration

The Employee’s State Insurance (ESI) scheme is a self-financing social security and health insurance program designed for Indian workers. It offers both economic and medical security to employees and their dependents. In addition to providing medical benefits, the scheme also provides coverage for temporary or permanent disablement and sickness.

ESI registration is mandatory for employers with 10 or more employees, where all employees earning Rs. 15,000 or less per month as wages are covered. However, as of 2013, this ceiling has been increased to Rs. 25,000. This compulsory insurance not only benefits employees but also helps employers mitigate their contingent liability for treatment and medical expenses arising from accidents that may occur on business premises or in factories.

EPF Registration

The Employees’ Provident Fund & Miscellaneous Provisions Act, 1952 is social security legislation aimed at providing future benefits to employees and their dependents in the event of unfortunate incidents. It applies to every establishment, such as a factory engaged in any industry, where 20 or more persons are employed.

EPF Registration is required within one month from the date of reaching 20 employees. Failure to register may result in penalties. Establishments with fewer than the prescribed number of employees can still register voluntarily with the Regional Provident Fund Office to provide Provident Fund benefits to their employees, known as covered voluntarily registration.

Additionally, EPF registration serves as proof of registration for newly established sole proprietorship firms, facilitating the opening of bank accounts for the firm.

MSME Registration

MSMEs play a pivotal role in the economic development of every nation, serving as engines of growth and fostering sustainable prosperity. Recognizing their importance, the Government of India provides support and encouragement to MSMEs through various subsidies, programs, and opportunities under the Micro, Small, and Medium Enterprises Development (MSMED) Act.

Under the MSMED Act, MSMEs are eligible for a range of incentives, including lower interest rates, excise exemptions, tax subsidies, electricity tariff subsidies, capital expenditure subsidies, and other forms of assistance. The term “MSME” encompasses micro, small, and medium-sized enterprises, encompassing a wide spectrum of businesses.

Both manufacturing and service sector enterprises falling within the micro, small, and medium-sized categories can obtain MSME registration under the MSMED Act. While MSME registration is not legally mandated, it is essential for availing the benefits offered by the government and banking sector. Rajput Jain & Associates assists businesses in obtaining MSME registration, thereby enabling them to leverage a multitude of advantages provided under the MSMED Act.

Food Business Operator License

A Food Business Operator (FBO) License is a mandatory license granted by the Food Safety and Standards Authority of India (FSSAI) under the Food Safety and Standards Act, 2006. This license is required for organizations involved in various activities related to food production, processing, packaging, transportation, distribution, import, catering, and sale of food or food ingredients.

To start a food company, compliance with FSSAI regulations is essential, including electronic registration on the FSSAI website and submission of a paper file drafted in accordance with the licensing criteria specified for central or state licensing/registration. The application for a Food Business Operator License must be submitted in the prescribed format along with supporting documents. Upon receipt of the application and supporting documents, FSSAI reviews and approves the application.

The list of documents required for license conversion may vary, but for new license applications, typically 18 to 24 types of documents need to be attached. These documents demonstrate compliance with food safety standards and regulatory requirements set forth by FSSAI. Obtaining an FBO license ensures that the food business operates in compliance with the law and meets the necessary safety standards to ensure the health and well-being of consumers.
